Groovi (“we,” “us,” or “our”) provides an online platform on which creatives can store and share song data. Groovi respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the Groovi mobile application (the “App”). 1. Information We Collect

a) Information You Provide Directly

  • Identification Information: When you create an account, we collect your email address, display name, stage name, and profile information you choose to provide.
  • IP and Music Data: When you use the , we store song data you create including song titles, lyrics, credits, recordings, voice memos, and associated metadata. If you upload audio files, we store those files securely in our cloud storage.
  • Financial Information: Our payment processor(s) will collect information necessary to process your payments, such as your payment card number, billing address, and other authentication details. However, we only store a tokenized version of such information and do not maintain payment card information on our servers.
  • Communication Data: Providing communication data is optional. We may collect such data (1) when you contact us for help or with issues or questions, and (2) when you respond to questionnaires, surveys, or requests for market research seeking your feedback and opinions.
  • Engagement Data: We may collect information and statistics regarding the music data with which a user engages.
  • b) Information Collected Automatically

    When you access the , we may automatically collect certain information including device type and operating system version, app usage data and interaction logs, crash reports and performance data, and IP address. We do not use any third-party tracking or advertising SDKs. We do not engage in cross-app tracking or fingerprinting. Specifically, the following data is collected and stored automatically in our system:

  • Log Data: This is information that your browser automatically sends when you access the App directly or via an internet browser. This includes your IP address, the browser type you’re using and its settings, the date and time of your access, and how you interacted with the App.
  • Device Data: We collect information about the device you’re using to access the App, including the name of the device, the operating system, and the internet browser. The specific device data that we collect may depend on the type of device you’re using and the device’s settings.
  • Location Data: We collect a rough estimate of your location via your IP address when you use the App.
  • Email Data: We use pixels in our email campaigns, which allow us to collect the date and time you open an email from us or click on any links in the email, as well as the IP address used to access the email.
  • Identifiable Access Data: We collect information about the date, time, and frequency a particular user or Recipient accesses a song, file, or playlist that was shared with them by another user. A “Recipient” is a third party with whom a user has shared music or other content with but who does not have an account on the App. Recipients have limited access and control regarding content on the App that has been shared with them, and they will not be required to create an account on the App in order to listen to content that has been shared with them.
  • c) Microphone and Media Access

    The App may request access to your device’s microphone to record voice memos and audio within the Ideas and Write features. Microphone access is only activated when you explicitly tap the record button. Audio recordings are stored locally on your device and, if you choose, uploaded to our secure servers. We never access your microphone in the background.

    d) Social Media Data from Third Parties

    We have pages on social media applications such as Instagram, X, and Facebook (“Social Media Pages”). When you interact with our Social Media Pages, we will collect personal data that you elect to provide to us, such as your contact information. Additionally, the companies that host our Social Media Pages may provide us with aggregate information and analytics about the use of our Social Media Pages.

    2. How We Use Your Information

    We use the information we collect to provide, maintain, and improve the and its features; to create and manage your account; to store and sync your song catalog, lyrics, credits, and recordings across your devices; to communicate with you about updates, support, and service-related notices; to detect, prevent, and address technical issues, fraud, or security concerns; and to comply with legal obligations.

    a) Personal Information – We use personal data to provide the ervices. We may use personal information for the following legitimate business interests:

  • To generally communicate with you and to respond to your questions, comments, feedback, and inquiries;
  • To send administrative updates to you, such as information regarding the and any changes to our policies, terms, and conditions;
  • To analyze how you interact with the and to provide, maintain, and improve the functionality and content of the and of our customer experiences and relationships. An example of this is that we may analyze the way you interact with the so that we can improve the layout and design of the ;
  • To enhance and personalize the experience we offer to you. An example of this is that we may combine your information that we’ve collected for the purposes of providing insights about you and about customer segmentation;
  • To develop and enhance our products and services and to contribute to our marketing strategy;
  • To maintain and improve the ;
  • To prevent fraud, criminal activity, or misuses of the and to ensure the security of our IT system, architecture, and networks; and
  • To comply with legal obligations and legal processes and to protect our rights, safety, or privacy and/or that of our affiliates, you, or other third parties.
  • In some cases, we may process your personal data based on your consent – for example, when you grant us access to your location or as otherwise provided in this Privacy Policy.
  • b) Aggregated Information – We may aggregate personal data and use that information to analyze the quality of the , to improve features of the , and for other similar purposes. We might also, from time to time, analyze the general behavior and characteristics of users of the and share that aggregated information, such as general user statistics, with potential business partners. We may collect aggregated information through the and through other means described in this Privacy Policy.

    c) Marketing – We may use the personal information you provide to us to contact you and tell you about products or services we believe might be of interest to you. For example, we may use your email address to send you special offers. You may opt out of receiving such marketing emails by following the instructions contained in each promotional email we send to you. Additionally, if at any time you no longer wish to receive future marketing communications, you may contact us at support@soundsgroovi.com. If you choose to unsubscribe from our marketing emails, you will no longer receive marketing communications, but we will continue to contact you regarding management of your account, administrative matters, and to respond to your questions or requests.

    3. How We Share Your Information

    We do not sell, rent, or trade your personal information to third parties. In certain circumstances, we may share the information described above without further notice to you, unless required by the law, in the following limited circumstances:

    Service Providers:

    We use Supabase (database and authentication) and cloud storage providers to operate the . We may share personal data with vendors and service providers, including providers of hosting services, cloud services, and other information technology services providers, email communication software and email newsletter services, advertising and marketing services, payment processors, payroll processors, customer relationship management and customer support services, and analytics services. These providers only process data on our behalf and pursuant to our instructions and are contractually obligated to protect your information.

    Legal Requirements:

    We may disclose your information if required to do so by law, in response to valid legal requests by public authorities (e.g., a court or government agency), or in the good faith belief that such action is necessary to (i) comply with a legal obligation, including to meet national security or law enforcement requirements, (ii) protect and defend our rights or property, (iii) prevent fraud, (iv) act in urgent circumstances to protect the personal safety of users of the , or the public, or (v) protect against legal liability.

    Business Transfers:

    If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, or sale of all or a portion assets, or transition of service to another provider (collectively a “Transaction”), your personal information and/or other information may be shared in the due diligence process with counterparties and other third parties assisting with the Transaction and transferred as part of that Transaction along with other assets. We will notify you of any such change.

    4. Data Storage and Security

    Your data is stored on secure servers provided by Supabase with row-level security enabled, ensuring that only you can access your own data. We use industry-standard encryption for data in transit (TLS/SSL) and at rest. While we strive to protect your personal information, no method of electronic storage or transmission is 100% secure. We cannot guarantee absolute security.

    5. Your Rights and Choices

    Access and Update:

    You can access and update your personal and profile information at any time through the App’s profile settings.

    Account Deletion:

    You may delete your account at any time from within the App. When you delete your account, we will permanently delete your account data, including your profile, songs, lyrics, credits, recordings, and all associated data. Deletion is processed promptly and is irreversible.

    Data Export:

    You may request a copy of your data by contacting us at support@soundsgroovi.com.

    Withdraw Consent:

    You may withdraw consent for optional data processing (such as microphone access) at any time through your device settings.

    Opt Out of Marketing Communications:

    You may opt out of receiving marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of every marketing email. You may continue to receive -related and other non-marketing emails.

    6. Children’s Privacy

    The not intended for children under the age of 13 (or the applicable age of digital consent in your jurisdiction). We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child without parental consent, we will take steps to delete that information promptly. If you believe a child has provided us with personal information, please contact us at support@soundsgroovi.com, and we will endeavor to delete that information from our databases.

    7. Third-Party Services

    The may contain links to or integrations with third-party services which are not operated or controlled by Groovi, including social media services (“ThirdParty Sites”). This Privacy Policy does not apply to those services. The information that you share with ThirdParty Sites will be governed by the privacy policies and terms of services of the Third-Party Sites and not by this Privacy Policy. By providing these links or integrations, we do not imply that we endorse or have reviewed these sites. We encourage you to review the privacy policies of any third-party services you access through the .

    8. International Data Transfers

    Please note that we are headquartered in the United States. Your information may be transferred to and processed in countries other than your country of residence. These countries may have different data protection laws. By using the , you consent to the transfer of your information to these countries. If we transfer personal data across borders such that we are required to apply appropriate safeguards to personal data under applicable data protection laws, we will do so.     We retain your personal information for as long as your account is active or as needed to provide you with the ervices and for as long as appropriate to fulfill the purpose for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements, to establish or defend legal claims, or for fraud prevention purposes. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of personal information, the purposes for which we process personal information, and whether we can achieve those purposes through other means, and the applicable legal requirements.

    10. California Privacy Rights (CCPA)

    If you are a California resident, you have the right to request disclosure of the categories of personal information we have collected, the purposes for which it is used, and the categories of third parties with whom it is shared. You also have the right to request deletion of your personal information, and the right not to be discriminated against for exercising your privacy rights.
